By accessing our website or placing an order, you agree to these Terms. Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

1. About Ombre Luve

Ombre Luve is a Norwegian clothing brand and online store operated by Legendary Arctic AS.

We sell clothing, accessories and related products through our online store, including to customers in Norway and other European countries where delivery is available.

2. Eligibility to Purchase

To place an order, you must be at least 18 years old or otherwise have the legal capacity or necessary consent to enter into a binding purchase agreement under the laws applicable to you.

By placing an order, you confirm that the information you provide is accurate and complete.

3. Orders and Formation of Contract

Products displayed on our website constitute an invitation to place an order.

When you place an order, you will receive an electronic order confirmation. A binding purchase agreement is formed in accordance with applicable consumer and contract law.

We reserve the right to refuse or cancel an order for legitimate reasons, including suspected fraud, misuse of our website, obvious pricing errors, payment failure, or product unavailability.

If we cancel an order after payment, we will refund the amount paid for the cancelled order.

4. Product Information

We make reasonable efforts to ensure that product descriptions, sizes, materials, photographs, colours, prices and other information displayed on our website are accurate.

However, colours and appearance may vary slightly depending on your device, display settings, lighting conditions and photography.

Measurements may also vary slightly due to manufacturing tolerances.

Such minor variations do not affect any statutory rights you may have if a product is defective or does not conform to the purchase agreement.

5. Prices

Prices are displayed in the currency selected or shown in the online store.

Applicable taxes and charges will be displayed in accordance with applicable law. We will show shipping costs and other applicable charges before you complete your purchase.

For deliveries outside Norway, additional import duties, customs charges or local taxes may apply depending on the destination and the delivery arrangement shown at checkout. If we do not collect such charges at checkout, the customer may pay them to the relevant authority or carrier.

We reserve the right to change our prices at any time. Price changes will not affect orders already concluded, except where permitted by law.

If an obvious pricing or technical error occurs, we reserve the right to correct the error and, where legally permitted, cancel the affected order and refund any amount already paid.

6. Payment

Available payment methods are displayed at checkout and may vary by country or region.

Third-party payment providers may provide payment services. Their own terms and privacy policies may apply to the payment services they provide.

The customer is responsible for providing accurate billing and payment information.

We may suspend or cancel an order if payment cannot be authorised or if we reasonably suspect fraudulent or unauthorised activity.

7. Shipping and Delivery

We ship to the destinations made available during checkout.

Available shipping methods, estimated delivery times, and shipping costs are displayed during checkout.

Any delivery times stated on the website are estimates unless expressly stated otherwise.

We will process and deliver orders within the time required by applicable law.

We are not responsible for delays caused by circumstances outside our reasonable control, but this does not affect any mandatory consumer rights.

The customer is responsible for providing a complete and accurate delivery address.

8. Uncollected or Undeliverable Parcels

If a parcel is returned to us because it was not collected, the delivery address was incorrect, or delivery could not be completed for reasons attributable to the customer, we may charge reasonable costs associated with the return and any new shipment, to the extent permitted by applicable law.

This does not limit the customer's statutory rights.

9. Right of Withdrawal

Consumers purchasing online generally have a statutory right to withdraw from the purchase within 14 days without providing a reason, subject to applicable law and any statutory exceptions.

For goods, the withdrawal period normally begins on the day you, or a third party designated by you other than the carrier, receive the goods.

To exercise your right of withdrawal, you must notify us clearly before the withdrawal period expires.

Notification can be sent to:

ombreluve@gmail.com

You may also use any withdrawal form provided with your order or made available on our website.

10. Returns Following Withdrawal

After notifying us that you wish to exercise your right of withdrawal, you must return the products within the period required by applicable law.

Unless otherwise stated in our Returns Policy or required by law, the customer is responsible for the direct cost of returning the products.

Returns should be sent to:

Ombre Luve
Strandvegen 134
9006 Tromsø

Handle products only as needed to determine their nature, characteristics, and functionality.

If the value of a product has been reduced because it has been handled beyond what is necessary for this purpose, we may make a deduction from the refund to the extent permitted by law.

Trying on clothing in a reasonable manner will not in itself remove your statutory right of withdrawal.

11. Refunds

When you exercise a valid statutory right of withdrawal, we will refund payments in accordance with applicable law.

Where required by law, this includes the standard delivery cost the customer originally paid. Additional costs resulting from choosing a more expensive delivery method than our standard delivery option may not be refundable.

We may withhold the refund until we receive the returned goods or you provide evidence that the goods have been returned, where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

Your bank or payment provider may require additional processing time before the refunded amount appears in your account.

12. Exchanges

If we offer exchanges, availability may depend on current stock.

Unless otherwise required by law, exchanges are subject to the conditions stated in our Returns Policy.

If a direct exchange isn't available, you may be asked to return the original item and place a new order.

13. Defective or Incorrect Products

If you receive an incorrect, damaged or defective product, please contact us as soon as reasonably possible at ombreluve@gmail.com and provide your order number and relevant information about the issue.

Consumers have statutory rights relating to defective or non-conforming products. These rights are separate from the 14-day right of withdrawal.

Nothing in these Terms limits your rights under applicable consumer protection legislation, including Norwegian consumer law where applicable.

14. Promotions and Discount Codes

Promotional offers and discount codes may be subject to separate conditions, including validity periods, minimum purchase requirements and product exclusions.

Unless otherwise stated, discount codes cannot be exchanged for cash and may not be combined with other offers.

We reserve the right to cancel or reject the use of promotional codes obtained or used fraudulently, unlawfully or contrary to the applicable promotional conditions.

15. Gift Cards

Where gift cards are offered, additional terms may apply.

Gift cards cannot normally be exchanged for cash except where required by law.

Expiry periods, if applicable, will be communicated in accordance with applicable law.

16. Intellectual Property

All content on the Ombre Luve website, including but not limited to photographs, text, graphics, illustrations, videos, logos, trademarks, product names, product designs, website design and other materials, is owned by Legendary Arctic AS, Ombre Luve or the relevant rights holder.

The content may not be copied, reproduced, distributed, modified, published, sold or commercially exploited without prior written permission, except where permitted by law.

The name Ombre Luve, its logos and other brand elements may be protected by trademark, copyright, design or other intellectual property laws.

17. Acceptable Use of the Website

You may use our website only for lawful purposes.

You must not attempt to interfere with the operation or security of the website, gain unauthorised access to systems or data, introduce malicious software, use automated systems in an abusive manner, or use the website for fraudulent or unlawful purposes.

We reserve the right to restrict access to our website where reasonably necessary to protect our business, customers or systems.

18. Third-Party Services

Our online store may use services provided by third parties, including Shopify, payment providers, shipping providers, analytics services and other technology providers.

Certain functionality may therefore be subject to those third parties' terms and privacy policies.

We are not responsible for third-party websites or services outside our control, except to the extent we cannot legally exclude responsibility.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, Legendary Arctic AS is not responsible for indirect losses or losses that were not reasonably foreseeable at the time the purchase agreement was entered into.

These limitations do not affect mandatory consumer rights.

20. Privacy

Legendary Arctic AS is the data controller for personal data processed in connection with Ombre Luve unless otherwise stated.

We process personal data in accordance with applicable data protection legislation, including the Norwegian Personal Data Act and the General Data Protection Regulation (GDPR).

Please see our Privacy Policy for further information about how personal data is collected, used, stored and protected.

21. Cookies

Our website may use cookies and similar technologies for essential functionality, analytics, personalisation and marketing.

Where consent is legally required, non-essential cookies will only be used in accordance with the choices you make through our cookie consent solution.

Further information is available in our Cookie Policy.

22. Changes to These Terms

We may update these Terms from time to time, for example because of changes to our services, website, business practices or applicable law.

The version applicable to your purchase will generally be the version in effect when you place your order, unless otherwise required by law.

The latest version will be available on our website.

23. Governing Law and Consumer Rights

Norwegian law governs these Terms and purchases from Ombre Luve, subject to any mandatory consumer protection rules that apply to customers in their country of residence.

Nothing in these Terms is intended to deprive consumers residing in another country of mandatory consumer protections that cannot lawfully be excluded by agreement.

We encourage customers to contact us first if a dispute arises so that we can attempt to resolve the matter.

Consumers may also have access to applicable public consumer complaint and dispute-resolution mechanisms.
